Practice Areas · Civil Litigation, Personal Injury & Wrongful Death
When someone else’s carelessness or bad faith costs you, you shouldn’t carry the cost alone.
McCain is a trial lawyer first. Trained at the Cochran firm and tested in federal and state courtrooms, he brings the same preparation to a fender-bender claim that he brought to a $4.4 million wrongful-death verdict. Most cases settle; the ones that settle best are the ones the other side knows you are ready to try.
Injury and wrongful-death cases are handled on a contingency fee: no attorney’s fee unless we recover for you. Court costs and case expenses are explained in the written fee agreement before we start. Civil disputes are quoted after a first conversation about what is at stake.

A record of taking on law enforcement, and winning.
McCain has carried police-misconduct and wrongful-death cases through federal trial courts and two circuit courts of appeals: the $4.4 million Champion verdict and its Sixth Circuit affirmance, and the Owsley exhumation and Seventh Circuit reversal. He takes these cases selectively, when the facts and the family call for it.
- Police misconduct and excessive force
- Wrongful death in custody or at the hands of law enforcement
- Botched investigations and cover-ups
- Section 1983 and related federal claims

What to expect
A free case review
For injury and wrongful-death matters, the first conversation costs nothing. Bring what you have; we’ll tell you if you have a case.
Evidence first
Records, witnesses, video, and experts are lined up early — before memories fade and footage is overwritten.
Ready for trial
Every case is built as if a jury will hear it. That is what gets fair offers — and fair verdicts when offers fall short.
Common questions
The insurance company called. Should I give a statement?
Not before you talk to a lawyer. Recorded statements are used to limit what they pay. Be polite, take their name, and call us.
How long do I have to file?
It depends on the claim and the state, and it can be short — especially for claims against a city, county, or state agency, which require early written notice. Don’t wait to ask.
What does it cost to hire you for an injury case?
Nothing up front. The attorney’s fee is a percentage of what we recover, agreed in writing before we start. If there is no recovery, there is no attorney’s fee; any responsibility for case costs is spelled out in that same agreement.
Do you take civil-rights cases?
Selectively. If you believe a loved one was harmed by police or a government agency, call. We will listen, and we will tell you honestly whether it is a case we can take.
