Privacy Policy
What this site collects, and what we do with it.
The short version
We collect what you choose to send us (through the consultation form, email, phone or payment page) and ordinary website analytics about how the site is used. We use it to respond to you, to run the firm, and to make the site better. We do not sell personal information, and we do not share what you tell us about a legal matter with advertisers or anyone outside the firm except as the rules of professional conduct allow.
Information you give us
When you request a consultation, you provide your name, email address, phone number, the kind of matter, and a brief description. When you email or call, you provide whatever you choose to include. When you pay a bill, your payment details are entered directly with our payment processor, Clio Payments (AffiniPay), and are not stored on this website.
Information about a legal matter is handled as confidential prospective-client or client information under the Illinois and Indiana Rules of Professional Conduct, which impose stricter duties than this policy.
Information collected automatically
This site is hosted on Squarespace, which records standard server information such as IP address, browser type, pages visited and referring site. We also use:
- Google Analytics 4, which reports traffic sources, pages viewed, time on page and clicks on things like phone numbers and buttons. IP addresses are not stored by Google Analytics 4.
- Microsoft Clarity, which records anonymized heatmaps and session replays showing how visitors scroll and click. Text typed into forms and other sensitive fields is masked before recording, and we do not try to identify individual visitors from these recordings.
These tools use cookies and similar technologies. You can decline non-essential cookies in the banner on this site, block cookies in your browser, or install Google's opt-out tool for Analytics. The site still works without them.
We do not place advertising pixels on the consultation form or the payment page.
How we use information
- To respond to your request and, if you become a client, to represent you.
- To check for conflicts of interest before accepting a matter.
- To send invoices, receipts and matter-related communications.
- To understand which pages and services visitors find useful, so we can improve the site.
- To comply with legal, ethical and record-keeping obligations.
If you give us your email address for a newsletter or event, we will use it for that purpose and you can unsubscribe at any time.
Who we share it with
Service providers that help us run the firm and this site, under contracts that limit their use of your information: Squarespace (hosting and forms), Google (Workspace email, Analytics), Microsoft (Clarity), Clio (practice management and payments) and our bank. We may disclose information when the law or a court requires it, or when the rules of professional conduct permit. We do not sell personal information and we do not share it for targeted advertising.
How long we keep it
Consultation requests that do not become matters are kept as long as needed for conflict checking and then deleted on a periodic schedule. Client files are retained for the period required by the rules of professional conduct and the firm's file-retention policy. Analytics data is retained according to the settings of each tool, generally 14 months for Google Analytics.
Security
This site is served over HTTPS. Payments are processed by a PCI-compliant processor and card numbers never reach our systems. No method of transmission is perfectly secure, which is one reason we ask you not to send sensitive details through the website before we have spoken.
Children
This site is not directed to children under 13, and we do not knowingly collect their information. Parents and guardians who need legal help for a minor should contact us directly.
Your choices and rights
You can ask us what personal information we hold about you, ask us to correct or delete it (subject to our professional obligations to keep client files), and opt out of marketing emails. Write to Info@RetainMcCain.com. Residents of states with consumer-privacy laws may have additional rights under those laws, which we will honor as they apply.
Changes
We will post any changes to this policy on this page and update the effective date above.
